1. Introduction

These Terms of Service ("Terms") govern your use of the services provided by Instant Home Repair ("we," "our," or "us"). By requesting, scheduling, purchasing, or using our services, you agree to be bound by these Terms.

2. Services

Instant Home Repair provides handyman and home repair services, which may include:

  • Small repairs
  • Light installs
  • Exterior repairs
  • Emergency repairs
  • Landlord turnover work
  • Painting
  • Plumbing and fixtures
  • Storm damage repairs

We reserve the right to modify, limit, refuse, or discontinue any Services at any time, including based on safety concerns, scope, location, scheduling, or availability.

3. Scheduling, Access, and Customer Responsibilities

To perform the Services, you agree to:

  • Provide accurate contact, address, and job information.
  • Provide safe and reasonable access to the work area (including pets being secured).
  • Ensure utilities (water, electricity, heat/AC as needed) are available when required for the job.
  • Disclose known hazards or conditions (water damage, mold, structural issues, electrical concerns, asbestos, lead paint, pests, etc.).
  • Obtain required approvals (landlord, HOA, permits, building approvals) before work begins, if applicable.

If we arrive and cannot perform the Services due to lack of access, unsafe conditions, incorrect job details, or other customer-related issues, you may be charged a trip fee and/or minimum service charge.

4. Estimates, Scope of Work, and Change Orders

Estimates: Estimates may be provided verbally, in writing, or electronically, and may be based on photos, descriptions, or an on-site review. Estimates are not final until the scope is confirmed.

Scope: Services are limited to the agreed scope of work.

Change Orders: If conditions change or you request additional work, we may revise pricing and timeline. Any added work must be approved before we proceed.

Some repairs reveal hidden damage or larger issues once work begins. If this happens, we will pause and discuss options before continuing.

5. Fees and Payment

You agree to pay all applicable fees for the Services as outlined in your service agreement, invoice, estimate, or written confirmation.

Key terms:

  • Due Upon Receipt: Unless otherwise agreed in writing, payment is due upon receipt of the invoice and/or upon completion of Services.
  • Minimum Charges / Trip Fees: Certain visits may include a minimum service charge or trip fee.
  • Late Payments: Late payments may be subject to fees, interest, and/or collection costs to the extent permitted by law.
  • Non-Refundable: Fees are non-refundable except as required by law or as otherwise stated in writing by us.

If you dispute an invoice, you must notify us promptly and in writing with specific details.

6. Cancellations and Rescheduling

We understand plans change. If you need to cancel or reschedule, please provide as much notice as possible. Cancellations or reschedules with short notice may result in a cancellation fee to cover reserved time and travel.

7. Materials and Customer-Supplied Items

If we supply materials, you agree to pay for them as part of the invoice.

If you supply materials or fixtures, you are responsible for ensuring they are correct, compatible, and in good condition.

We are not responsible for defects in customer-supplied materials, fixtures, or parts.

If customer-supplied items delay completion (missing parts, wrong sizes, damaged items), additional trips or labor may be billed.

8. Warranties and Workmanship

We stand behind our workmanship for the Services we perform. However, this does not cover:

  • Normal wear and tear
  • Misuse, abuse, neglect, or lack of maintenance
  • Pre-existing damage or hidden conditions
  • Manufacturer defects in parts or fixtures
  • Work performed by others before or after our Services
  • Issues caused by structural movement, water intrusion, pests, mold, or other environmental factors

If you believe there is a workmanship issue, you must notify us within a reasonable time so we can evaluate and, if appropriate, address it.

9. Acceptable Use and Conduct

You agree to treat our team with respect and maintain a safe work environment. We may refuse or stop work if we encounter harassment, unsafe conditions, illegal activity, or unreasonable behavior.

10. Intellectual Property

We own all rights, title, and interest in and to our website, content, branding, estimates, documents, photos we create, and materials provided by us, including all intellectual property rights. You are granted a limited, non-exclusive, non-transferable, and revocable license to view and use our website and materials for personal, non-commercial purposes.

11. Confidentiality

You agree to maintain the confidentiality of any non-public information disclosed to you by us, including business, technical, operational, and pricing information, unless disclosure is required by law.

12. Privacy

Your use of our Services and website may be governed by our Privacy Policy, if available, which is incorporated by reference into these Terms.

13. Limitation of Liability

To the maximum extent permitted by law, Instant Home Repair will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the Services.
  • Any unauthorized access to or use of systems or information.
  • Any interruption or delay in scheduling or performance of Services.
  • Hidden damage, pre-existing conditions, or conditions outside our control.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Services will not exceed the amount you paid us for the specific Service that gave rise to the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Instant Home Repair and its owners, affiliates, officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to:

  • Your access to or use of the Services.
  • Your violation of these Terms.
  • Your violation of any law or the rights of a third party.
  • Customer-supplied materials, instructions, or site conditions.

15. Termination and Refusal of Service

We may terminate or suspend access to our Services, cancel appointments, or refuse service at our sole discretion, without prior notice or liability, for any reason, including if you breach these Terms, fail to pay, provide unsafe working conditions, or misrepresent the scope of work.

16. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions.

17. Links to Other Websites

Our website or communications may contain links to third-party websites or services that are not owned or controlled by Instant Home Repair. We assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge that we are not responsible or liable for any damage or loss caused by use of any third-party content, goods, or services.

18. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in New Jersey, in accordance with the rules of the American Arbitration Association, except where prohibited by law. You agree that arbitration will be conducted on an individual basis and not as a class action, to the extent permitted by law.

19. Changes to the Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide reasonable notice by updating the Effective Date and posting the revised Terms on our website (or by another method we choose). Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
